A class action settlement has been reached in a case brought by Melvin Stakely Jr. against Windsor Palms Care Center of Artesia, Windsor Twin Palms Healthcare Center LLC, and Modern Hero Inc. The lawsuit, filed on March 17, 2021, with an amended complaint filed on June 7, 2021, centers on employment-related claims affecting workers at the defendants’ facilities. The settlement applies to all current and former non-exempt employees who worked for the defendants in California during the class period, which runs from March 17, 2017 through the date of preliminary approval. Eligible class members will receive individual settlement payments from the net settlement amount after deductions for court-approved attorney fees and costs, as well as a representative enhancement payment to the named plaintiff in recognition of his role in pursuing the case. The defendants have agreed to compile a complete class list within ten business days of preliminary approval notification, which will be used to identify and contact eligible participants. Class members have several options regarding their participation.
They may do nothing and remain part of the settlement to receive their payment distribution. Alternatively, they can submit a request for exclusion if they wish to opt out of the settlement entirely.
