Overview

Roberto Orozco brought a lawsuit against Clearwater Senior Living, LLC and CSL Berkshire Operating Company, LLC, alleging labor law violations affecting current and former employees. The case was filed in Ventura Superior Court and proceeded as a class action on behalf of all similarly situated workers, as well as under California’s Private Attorneys General Act (PAGA). The court has granted preliminary approval of a settlement agreement valued at $1,100,000. The settlement covers employees who worked for the defendant companies during the class period spanning July 18, 2018 through February 21, 2026, with PAGA claims covering the period from July 7, 2021 through January 24, 2026.

Class members will receive notice of the settlement by mail in both English and Spanish. Any unclaimed settlement funds will be distributed to Ventura County Legal Aid as a cy pres beneficiary. Class members have several options available to them. They may do nothing and remain part of the settlement to receive their share of the recovery.

Alternatively, they can submit a claim form if required by the settlement administrator. Class members also have the right to exclude themselves from the settlement by filing a valid request for exclusion with the settlement administrator. Additionally, those who wish to voice concerns about the settlement’s fairness may object and be heard at the final approval hearing. A final fairness hearing is scheduled to determine whether the settlement, attorney fees, and service awards should receive final court approval.
