Overview
YRC Worldwide Inc. and Yellow Roadway Corporation are the subject of a federal class action lawsuit alleging systematic violations of California wage and hour laws. The case, brought by plaintiffs Felipe Alvarez and Jerald Shroeder on behalf of current and former workers, centers on claims that the transportation company failed to provide legally required meal and rest breaks, improperly deducted wages, and issued inaccurate wage statements. Specifically, the lawsuit alleges that YRC did not provide second meal breaks for shifts exceeding 10 hours, failed to offer timely first meal breaks before the fifth hour of work, withheld rest breaks for driver employees working more than 3. 5 hours, and automatically deducted 30 minutes of pay from non-bell system employees regardless of whether they actually took a meal break. The plaintiffs seek recovery of unpaid wages, premium wages, and penalties.
YRC denies all allegations and maintains that it complied with California law and applicable collective bargaining agreements. The class includes all hourly employees who worked for YRC at any time between December 14, 2007, and September 19, 2018. The court certified the case as a class action on September 19, 2018, establishing multiple subclasses based on job classification and shift length to address different types of alleged violations. Eligible workers may fall into categories such as the Second Meal Class, Unpaid Wage Class, Untimely Meal Class, Driver Meal Class, or Driver Rest Class, depending on their employment history and work patterns during the class period. As the case remains pending with no settlement reached, class members have several options available.
You may take no action and remain part of the class, which means you will be bound by any eventual court decision or settlement. Alternatively, you may opt out of the lawsuit entirely, which would exclude you from any recovery but also prevent the judgment from affecting you. You also have the right to object to any proposed settlement or judgment. For more information about the case or to discuss your eligibility, contact the settlement administrator toll-free at 1-(888) 373-2581 or visit the case website. The court will notify all class members if and when a settlement is reached.
