Overview
Employees of Morningstar Senior Management, LLC and Morningstar Senior Living, LLC may be entitled to compensation through a recently approved class action settlement. The lawsuit, brought by plaintiffs Arthur Ablay, Allen Jardin, and Jopercy Beltran, alleges that the companies violated California labor laws by failing to pay minimum and overtime wages for all hours worked, providing required meal and rest breaks, paying wages on time during employment and upon termination, and furnishing accurate wage statements to employees. The case was filed in Santa Clara County Superior Court under case number 24CV440710. The settlement applies to two groups of workers. Class Members include all California non-exempt employees who worked for either defendant from September 18, 2020 through July 14, 2025 and did not sign an arbitration agreement.
PAGA Members—those eligible under California’s Private Attorneys General Act—consist of non-exempt employees who worked during the period from April 1, 2023 through July 14, 2025. On April 30, 2026, the court granted preliminary approval of the settlement, and a Final Approval Hearing is scheduled for November 5, 2026 at 1:30 p. in Department 22 of the Santa Clara County Superior Court, located at 161 North First Street, San Jose, California 95113. If you take no action, you will automatically participate in the settlement and receive a payment from the settlement fund once the court grants final approval. By doing so, you will release your right to pursue wage and hour claims against the defendants based on the facts in this case.
Alternatively, you may opt out of the class settlement by submitting a written Request for Exclusion to the Settlement Administrator by July 27, 2026, though PAGA Members cannot opt out of that portion and remain eligible for PAGA fund payments. Participating Class Members may also submit written objections by July 27, 2026, or appear at the Final Approval Hearing on November 5, 2026 to voice concerns about the settlement. Remote appearances are available through the court’s virtual platform; interested parties should contact class counsel at least three days before the hearing if possible.
