Overview
A class action lawsuit has been filed in the U. District Court for the Central District of California against Walmart Associates, Inc. The case, brought by plaintiffs Jessica Hernandez and Carol Turner, targets alleged violations of California labor law affecting hourly, non-exempt workers employed at Walmart stores in California from November 17, 2017 onward. The plaintiffs claim that Walmart failed to provide meal breaks, furnish accurate itemized wage statements, pay all wages owed to departing employees, and reimburse workers for cell phone expenses related to job duties. The lawsuit seeks damages, statutory penalties, restitution under California’s Unfair Competition Law, and civil penalties under the Private Attorneys General Act.
Walmart has denied all allegations, and the court has made no determination regarding the merits of the claims. If you worked as a non-exempt employee at a Walmart store in California during the relevant period, you may be part of the class affected by this litigation. The case is currently in the investigation phase, and the plaintiffs’ legal team is attempting to contact current and former employees to gather information about their work experiences. A neutral third-party administrator is notifying potential class members about the disclosure of their personal contact information to the plaintiffs’ attorneys.
