Overview
Plaintiffs Archie Shakespeare and Troy Brown filed a class action lawsuit against Ameri-Force Craft Services, Inc. , alleging employment-related violations affecting workers in California. The case, filed in San Diego Superior Court, centers on claims that the defendant failed to comply with state labor laws regarding compensation and working conditions for its non-exempt employees. The lawsuit also includes claims brought under California’s Private Attorneys General Act (PAGA), which allows employees to pursue penalties on behalf of the state for labor code violations. The settlement applies to all individuals employed by Ameri-Force Craft Services as non-exempt workers in California from April 1, 2017 through the date of preliminary approval.
This includes employees assigned to work on behalf of National Steel and Shipbuilding Company (NASSCO). The court has preliminarily approved the settlement, finding it fair, adequate, and reasonable based on arms-length negotiations between the parties and the involvement of an experienced mediator. The settlement covers all claims that could have been brought based on the facts alleged in the case, with the exception of certain individual claims by Plaintiff Shakespeare against NASSCO. Class members have several options regarding this settlement. They may do nothing and remain part of the class, in which case they would be bound by the settlement terms and any judgment.
Alternatively, class members may submit a claim to receive compensation if required by the settlement terms. Those who wish to exclude themselves from the class may opt out, which would preserve their right to pursue individual claims. Class members also have the right to object to the settlement at the final approval hearing. The court has appointed CPT Group as the settlement administrator to manage the claims process. A final approval hearing will determine whether the settlement receives full court approval.
