Overview
Former call center employees Tiffany Hill and Michelle Anderson brought a lawsuit against multiple companies operating Washington State call centers, including Xerox Business Services, LLC, Livebridge, Inc. , and Affiliated Computer Services entities. The plaintiffs alleged that these defendants violated Washington wage and hour laws by failing to pay minimum wage for all hours worked, refusing to pay overtime compensation, willfully withholding wages, and violating provisions of the Washington Revised Code. The defendants have denied all allegations and asserted various legal defenses. The case has been active for over 13 years, with court rulings favoring each side at different stages.
Rather than continue with further litigation, trial proceedings, and potential appeals, both parties agreed to settle the matter. Under the proposed settlement, the defendants will pay a total of $9,100,000 to resolve all wage and hour claims. Approximately 5,740 employees who worked at these call centers under an “Activity Based Compensation” plan paying per-minute rates for specific work activities between June 5, 2010, and January 16, 2015, qualify as settlement class members. The class is divided into two groups: approximately 4,774 employees who did not participate in a related federal lawsuit called Douglas, and roughly 966 employees who did join that case. Class members have several options regarding this settlement.
You may do nothing and automatically receive your share of the settlement payment—you should simply provide updated contact information to the settlement administrator to ensure delivery. Alternatively, you can object to the settlement by writing to the court if you disagree with its terms; however, objecting does not prevent you from receiving payment if the settlement is approved. You also retain the right to opt out of the settlement entirely, which would allow you to pursue separate legal claims against the defendants if you choose. The court must still grant final approval of the settlement before payments are distributed. Assuming approval and the resolution of any appeals, the settlement administrator expects to distribute payments in April 2026.
