Overview

Melissa Lehuta brought a class action lawsuit against Heavy Restaurant Group LLC, which operates the Meet the Moon and Pablo y Pablo restaurants. The case centers on allegations involving wage and hour violations affecting hourly employees who worked in front-of-house service positions at these establishments. The settlement class includes approximately 170 individuals who worked as servers, bartenders, bussers, hosts, expeditors, cocktailers, or in similar service roles at either restaurant location between November 12, 2017 and March 18, 2020.

A Washington Superior Court judge granted preliminary approval of the settlement on June 29, 2021, establishing a maximum settlement fund of $155,000 to compensate affected workers. Class members will receive their proportional share of this fund based on the number of shifts they worked during the settlement period. Class members have several options regarding their participation.

Those who take no action will automatically receive their pro-rata payment and will be bound by the settlement’s release terms. Alternatively, workers may submit an objection to the settlement if they believe it is unfair or inadequate. Class members also retain the right to exclude themselves from the settlement entirely, which would prevent them from receiving compensation but would preserve their ability to pursue individual claims.
