A class action lawsuit brought by Liset Viamontes and Aldo Alpizar against Adriana’s Insurance Services Inc. and related entities has reached a settlement that received final court approval on June 29, 2021. The case, filed on March 7, 2013, centers on allegations that the defendant companies violated California labor laws by failing to provide meal and rest breaks, underpaying workers, withholding overtime compensation, and neglecting to furnish proper wage documentation to their employees.

The settlement applies to all non-exempt workers employed by the defendant companies in California between March 7, 2009 and March 11, 2019. The court has certified this group as the eligible class and determined that the settlement terms are fair and reasonable. Class members will receive individual settlement payments calculated according to a methodology approved by the court.

Four individuals—Leticia Mancera, Oscar Bernal, Xanadau Almendarez, and Claudia Black—successfully requested exclusion from the settlement and are not bound by its terms. Upon the settlement’s effective date, participating class members will release the defendant companies from liability related to the alleged violations, which include failure to provide meal periods, failure to authorize rest periods, failure to pay overtime and minimum wages, failure to pay final wages upon termination, failure to maintain proper employment records, failure to provide accurate wage statements, unfair business practices, and violations of California’s Labor Code Private Attorneys General Act. Class members who do nothing will automatically participate in the settlement and receive their calculated payment.
