Overview
Essex brought a class action lawsuit against Pete’s Flying Aces, Inc. , alleging wage and hour violations affecting service workers at the company’s Palace Casino location in Lakewood, Washington. The case was filed in Pierce County Superior Court and centers on claims related to compensation practices for hourly, non-exempt employees working as bartenders, bussers, dishwashers, food servers, bar servers, line cooks, and bar supervisors during the period from June 7, 2019, through October 20, 2022. The parties engaged in settlement negotiations between July 2022 and reached a settlement agreement that both sides believe is fair and reasonable.
Pete’s Flying Aces has not admitted to any wrongdoing and continues to deny all allegations; the company agreed to settle solely to avoid the costs and burdens of continued litigation. The settlement covers approximately 128 current and former employees who worked in the specified positions during the class period. The settlement is pending final approval from the Superior Court, after which a Final Judgment will be issued. The settlement becomes effective once the court approves it and the Final Judgment becomes final—either when the appeal period expires or, if an appeal is filed, when the appellate court issues its final decision.
Class members have several options regarding this settlement. Those who wish to remain part of the settlement class and potentially receive compensation may do nothing and await further instructions from the Settlement Administrator, CPT Group, Inc. Alternatively, class members may choose to opt out of the settlement entirely, which would exclude them from any recovery but preserve their right to pursue individual claims. Class members also have the opportunity to object to the settlement terms.
