Duenas et al v Exer Medical Corporation et al Class Action Settlement

Published: June 26, 2026

Overview

A settlement has been reached in a class action lawsuit alleging wage and hour violations at Exer Medical Corporation. The case, filed in Los Angeles Superior Court, was brought by four named plaintiffs—Kassandra Duenas, Tammy Bibian, Manilou Redor, and Todd Sherline—on behalf of current and former hourly employees in California. The lawsuit centers on claims that the company failed to comply with state wage and hour laws, including issues related to employee compensation and labor code violations. The settlement covers all non-exempt and hourly paid employees who worked for Exer Medical Corporation in California during two distinct periods.

For the main class action component, the eligible period runs from May 18, 2020 through January 31, 2024. For claims under California’s Private Attorneys General Act (PAGA), which allows employees to pursue certain labor violations on behalf of the state, the covered period is March 1, 2021 through January 31, 2024. The defendant has agreed to pay a total of $1,116,000 to resolve all claims. After deducting attorney fees, administrative costs, payments to the state labor agency, and service awards to the named plaintiffs, the remaining funds will be distributed to eligible class members based on the number of weeks they worked during the settlement period.

Class members have several options regarding this settlement. Those who wish to participate and receive a payment need not take any action—they will automatically be included unless they opt out. Employees who prefer not to participate in the settlement may submit a request to exclude themselves from the class. Class members also have the right to object to the settlement terms if they believe the agreement is unfair.
