Overview

Servers and bartenders who worked at two prominent New York event spaces are pursuing a class action lawsuit alleging they were not properly compensated for gratuities owed under state labor law. The case, filed in New York State Supreme Court in New York County, names Gotham Hall and Ziegfeld Ballroom as defendants, along with related operating entities and individual owners Simon Auerbacher and Bruce A. The named plaintiffs—Vincent Settecasi, Pamela Graham, and Coree Spencer—worked at these venues and brought the lawsuit on behalf of themselves and other current and former service employees who experienced similar wage violations. The lawsuit centers on allegations that the defendants failed to pay gratuities that should have been distributed to servers, bartenders, and other service staff who worked catered events at either venue. The class includes all individuals who performed service work at Gotham Hall or Ziegfeld Ballroom between March 2012 and April 13, 2022.

The defendants have denied any wrongdoing. It is important to note that receiving this notice does not guarantee you are entitled to compensation, nor has the court made any determination regarding the merits of the case at this stage. If you worked as a server, bartender, or in a related service position at either venue during the specified timeframe, you are automatically included in the class and need not take any action to participate.
