Overview
Participants and beneficiaries of the Columbus Regional Healthcare System Retirement Savings Plan may be entitled to compensation through a proposed class action settlement. The lawsuit, filed in the United States District Court for the District of Georgia, involves allegations that Columbus Regional Healthcare System, Inc. breached its fiduciary responsibilities under federal pension law (ERISA) in managing the retirement plan. Specifically, the plaintiffs claim the company’s mismanagement of the plan resulted in financial losses to participants and beneficiaries. Columbus Regional denies these allegations and maintains various legal defenses.
The two sides have now agreed to settle the dispute, pending court approval. Class members include anyone who participated in or received benefits from the retirement plan between February 2, 2015 and May 31, 2019. If the settlement receives court approval, eligible class members will receive payments funded by Columbus Regional according to a proposed allocation plan. Notably, no action is required to receive a payment—eligible individuals will be paid automatically if the settlement is approved. The settlement also includes a release of claims related to the plan’s administration and management.
The court will hold a fairness hearing on June 12, 2024 at 9:30 a. to decide whether to approve the settlement, the allocation plan, and attorneys’ fees. Class members cannot opt out of this settlement, but they retain other rights. Those wishing to challenge the settlement may submit written objections to the court and counsel by May 22, 2024. Additionally, class members who file written objections and provide notice of intent to appear may speak at the June 12, 2024 hearing at their own expense to voice concerns about the settlement’s fairness.
