Overview
Plaintiff Mary Nguyen filed a lawsuit against Westlake Services Holding Company and related defendants, alleging violations of the Employee Retirement Income Security Act (ERISA). The case centers on claims that the defendants failed to pay benefits owed under the Westlake Services Holding Company Employee Stock Ownership Plan and did not adhere to the plan’s terms. On September 6, 2024, a federal judge in the Central District of California granted preliminary approval of a settlement agreement, moving the case toward resolution. The settlement applies to individuals who participated in the company’s defined contribution retirement plan and whose employment with Westlake or its affiliates ended between January 1, 2019 and March 31, 2020, provided they maintained an account balance exceeding $5,000 at the time of termination.
Beneficiaries and alternate payees of eligible participants—including those subject to Qualified Domestic Relations Orders—also qualify for compensation. Deceased participants’ beneficiaries, executors, heirs, and personal representatives may receive distributions on behalf of the deceased participant’s estate. Class members have several options regarding their settlement payments. Those who wish to receive funds as a direct check can do so, though the settlement administrator will withhold 20 percent or more for federal taxes.
Alternatively, eligible participants may elect to have their payment transferred directly to a retirement account as a rollover, though the settlement administrator notes there is no guarantee these funds qualify for rollover or tax-preferred treatment—class members should consult their tax advisor about this option. To make a payment election, the Class Member Payment Election Form must be completed and mailed to the Westlake ERISA Settlement Administrator at 600 N. Jackson Street, Suite 205, Media, PA 19063, with a deadline of January 2, 2025.
