Overview
A proposed class action settlement has been authorized by the Superior Court of California in Alameda County to resolve allegations that several interconnected property management entities violated Oakland’s landlord-tenant protections. The defendants—Neveo Mosser, the Mosser Companies, Inc. , and various affiliated limited liability companies and partnerships operating apartment complexes in the area—are accused of improperly re-billing tenants for utility costs including water, sewer, and garbage removal services. According to the lawsuit, these charges were divided among rental units and assessed alongside administrative fees in ways that allegedly breached the City of Oakland’s Rent Adjustment and Tenant Protection Ordinances, as well as California’s Unfair Competition Law.
The case, filed by class representatives Andrew Yen, James Ball, Kaitlin Blanco, and Melina Tessier, seeks compensation for all individuals who rented from these defendants between May 25, 2017 and October 31, 2023. If you were a tenant at any of the defendant-operated apartment complexes during this period and paid for utility cost estimates and related administrative fees, you are likely eligible for a share of the settlement. The defendants have agreed to contribute $975,000 to the settlement fund, though the exact amount each class member receives will depend on the number of billing cycles during which they were a tenant. The court has already granted preliminary approval to the settlement, but final approval remains pending.
Class members have several options regarding participation. If you take no action, you will automatically remain part of the settlement and receive a payment based on your tenancy records. If you believe the defendant’s records regarding your lease period or billing cycles are inaccurate, you may dispute this information by completing and submitting the dispute form postmarked no later than November 8, 2024. You also retain the right to object to the settlement by filing concerns with the court, or you may opt out entirely if you prefer not to participate.
