Overview
A class action settlement has been approved in a lawsuit brought by Angelina Vasquez against CP Retail, LLC and Winmark Corporation. The case centers on allegations of wage and hour violations affecting current and former hourly employees in California. The lawsuit involves workers who were employed by CP Retail at its California locations between February 11, 2017 and January 16, 2022.
The class also includes employees covered under California’s Private Attorneys General Act (PAGA) provisions for the period from October 13, 2019 through January 16, 2022. The court approved the settlement on February 28, 2023, following a final approval hearing held at the Stanislaus County Superior Court in Modesto. The settlement was filed on February 11, 2021.
The settlement encompasses 278 class members, all of whom received notice of the proposed settlement and had the opportunity to participate. During the 45-day opt-out period, no class members requested exclusion from the settlement, and no objections were filed, resulting in 100 percent participation. Class members who received notice were informed of their rights and the settlement terms through detailed notice packets that included individualized share forms.
