Overview
Nancy Garcia filed a class action lawsuit against Common Area Maintenance Services, Inc. (doing business as CAM Services) and individual David Herrera, alleging employment law violations affecting workers in California. The case, filed in Los Angeles Superior Court, centers on claims involving non-exempt employees who worked for the defendant company. On August 25, 2023, the court granted preliminary approval of a proposed settlement agreement between the parties, moving the case toward resolution.
The settlement applies to all current and former non-exempt employees who worked for Common Area Maintenance Services, Inc. in California from May 14, 2016 through the date of preliminary approval. The court has scheduled a final approval hearing for January 5, 2024, at which a judge will determine whether the settlement terms are fair and reasonable, and will decide on attorney fees and compensation for the named plaintiff. CPT Group Administrators has been appointed to manage the settlement process, with administration costs capped at $20,000.
Class members will receive notice of the settlement through multiple channels. Within 14 days of preliminary approval, the defendant must provide the settlement administrator with employee information. Within 28 days, the settlement notice will be posted online, and affected workers will be contacted directly. Any settlement funds that remain uncashed will be distributed to a charitable organization selected by the defendant and approved by the court.
