Overview
A class action lawsuit has been filed against Equilon Enterprises LLC, operating as Shell Oil Products US, on behalf of employees who claim they experienced workplace violations. Equilon Enterprises LLC dba Shell Oil Products US, was originally filed on June 4, 2019, in the U. District Court for the Northern District of California. The plaintiffs—Marco Dimercurio, Charles Gaeth, John Langlitz, and Malcolm Synigal—brought the action on behalf of themselves and other workers in similar circumstances, alleging employment-related violations by the defendant company.
The litigation has progressed through discovery, investigation, and mediation, with the case now moving toward settlement approval. A hearing is scheduled for May 9, 2024, at 10:00 a. in Courtroom 8 on the 19th Floor before Judge Jacqueline Scott Corley, where the court will consider approval of the settlement agreement and attorneys’ fees. This is an opt-out only settlement, meaning class members are automatically included unless they take action to exclude themselves.
If you are a member of this class, you have several options available. You may do nothing and remain part of the settlement, in which case you would be bound by its terms and eligible for any compensation determined. Alternatively, you can opt out of the settlement if you prefer to pursue your own legal action separately. You also have the right to object to the settlement or to the requested attorneys’ fees and expenses if you believe the terms are unfair.
