Overview
A class action settlement has received preliminary approval in a case brought by employees against SFFIT Ventures LLC and ASPYR Holdings, LLC. The lawsuit, filed on September 8, 2022, centers on employment-related claims affecting workers in California. A San Diego Superior Court judge granted preliminary approval of the settlement on May 3, 2024, moving the case toward final resolution. The settlement covers all individuals who worked as hourly, non-exempt employees at SFFIT Ventures in California between September 8, 2018, and October 31, 2023.
Class members are eligible to receive a proportionate share of the net settlement amount without needing to submit a claim form. The court found the settlement amount to be fair and reasonable when weighed against the risks and costs of continuing litigation, and it also approved a separate allocation for PAGA penalties as required under California law. Class members have several options regarding this settlement. They may do nothing and receive their proportional share automatically.
Alternatively, they can request exclusion from the settlement by following the procedures and meeting the deadline specified in the settlement notice. Class members also have the right to object to the settlement and may appear at the final approval hearing to voice their concerns. The court determined that notice sent to class members’ last known addresses, with address verification and skip tracing efforts, constitutes adequate notification of their rights and the settlement terms. The case is proceeding toward a final approval hearing, where the court will make a determination on whether to grant full approval of the settlement.
