Overview
Participants in the KPMG 401(k) Capital Accumulation Plan may be entitled to compensation through a class action settlement that received final court approval on July 23, 2024. The lawsuit, filed in the United States District Court for the District of New Jersey, challenges how KPMG managed the retirement plan and its predecessor and successor plans. If you participated in the Plan at any point between October 26, 2015, and March 4, 2024, you are likely a member of the settlement class and your rights may be affected by this resolution.
Under the settlement terms, eligible participants will receive compensation without needing to submit a claim form. If you currently maintain a positive account balance in the Plan, your settlement payment will be automatically deposited into your Plan account. For former participants no longer in the Plan, the Settlement Administrator will distribute payments directly to you.
Alternatively, you have the right to opt out of the settlement or object to its terms. To object, you must submit a written statement to the Court and the parties’ attorneys by June 21, 2024, explaining your concerns. Those who filed timely objections could have attended the Fairness Hearing held on July 22, 2024, to present their position to the Court, though attendance required filing both a written objection and a Notice of Intention to Appear by the deadline.
