Overview
A federal court in Massachusetts has preliminarily approved a class action settlement involving the Children’s Hospital Corporation Tax-Deferred Annuity Plan. The lawsuit, filed by four plan participants—Adilson Monteiro, Karen Ginsburg, Jason Lutan, and Brian Minsk—alleges that Children’s Hospital Corporation and its board of directors violated the Employee Retirement Income Security Act of 1974 (ERISA) through their management and administration of the retirement plan. District Court for the District of Massachusetts under case number 1:22-cv-10069-JEK, and the settlement agreement was finalized on April 2025. The settlement applies to all individuals who participated in or received benefits from the Children’s Hospital Corporation Tax-Deferred Annuity Plan at any point between January 18, 2016, and the date the court issued its preliminary approval order on May 12, 2025.
This includes current and former plan participants, beneficiaries of deceased participants, and alternate payees under qualified domestic relations orders. The court has appointed the four named plaintiffs as class representatives and designated Miller Shah LLP and Capozzi Adler, P. as the legal representatives for the class. Class members have several options available to them.
They may take no action and remain part of the settlement. Alternatively, they can submit a claim if required by the settlement terms. Class members also have the right to opt out of the settlement entirely if they prefer to pursue their own legal action. Additionally, those who wish to voice concerns about the settlement can file an objection with the court.
