Overview

Norma Valenzuela has filed a class action lawsuit on behalf of participants in the Advantage 401(k) Savings Plan against Advantage Sales & Marketing LLC (also doing business as Advantage Solutions), along with the company’s Board of Directors and the Plan’s Administrative Committee. The lawsuit alleges that these defendants breached their fiduciary duties under the Employee Retirement Income Security Act (ERISA) by charging participants unreasonable fees and failing to properly monitor and maintain suitable investment options within the plan. As of December 31, 2022, the Advantage 401(k) Savings Plan had approximately 11,822 participants with combined account balances totaling roughly $690 million, making it one of the largest defined contribution plans in the country.

Under ERISA, plan fiduciaries are required to act in the exclusive interest of participants, select prudent and diverse investment options, and ensure that all plan expenses are reasonable relative to the services provided. The lawsuit claims that Advantage and its leadership failed to meet these obligations throughout the class period, which began six years before the lawsuit was filed on March 4, 2024, and continues through the date of judgment. A settlement has been proposed in this case.
