Overview

Plaintiff Maggie Chong brought a class action lawsuit against Jinglebells LLC, Jingle Bells Enterprises LLC, and Jinglebells Holding LLC, alleging employment-related violations. The complaint was filed on June 2, 2021, in Alameda County Superior Court. On January 21, 2025, the court held a hearing to consider preliminary approval of a proposed settlement agreement that would resolve the claims on behalf of all affected workers. The settlement covers all individuals employed by the defendant companies in California and classified as non-exempt employees between June 2, 2017, and April 28, 2024.

The court found that the settlement terms appear reasonable and fair to class members, noting that the plaintiff conducted thorough investigation and research into the case’s strengths and weaknesses. The judge also determined that settling now will prevent additional litigation expenses and delays that would result from continuing to pursue the case. Class members have several options regarding how to proceed. They may take no action and remain part of the settlement to receive compensation.

Alternatively, they can exclude themselves from the settlement entirely and pursue their own claims against the defendants. Class members also have the right to object to the settlement terms and appear before the court to voice their concerns. Those wishing to opt out or object must follow the procedures outlined in the settlement agreement and the class notice. Any settlement payments that remain uncashed after a specified void date will be distributed to CALICO, the children’s advocacy center for Alameda County, or another foundation approved by the court.
