Overview
A class action settlement has been reached in a wage and hour dispute involving multiple medical and wellness facilities. Hollie Ballard brought the lawsuit on behalf of herself and other employees against Ramin Tayani M. and related business entities, including Tayani Institute, West Coast Center for Surgeries, Dermabare of Mission Viejo, Inside Lifetime Athletics, and San Diego Eye Care Center. The case, filed on November 30, 2020, in Orange County Superior Court, centers on allegations that the defendants violated California wage and hour laws, specifically the state’s Industrial Welfare Commission Wage Orders.
The settlement applies to all employees who worked for any of the defendant businesses during the relevant period and were subject to the wage violations at issue. The total settlement fund has been established, with a portion designated for eligible class members’ compensation. The defendants’ legal representatives and the plaintiff’s attorneys have agreed to the terms, pending court approval. Administrative costs associated with processing the settlement are anticipated to reach approximately $8,000.
Class counsel may seek attorney fees of up to one-third of the gross settlement amount, along with additional litigation costs not to exceed $10,000, subject to court authorization. Class members will receive notice of the proposed settlement and have several options available to them. They may do nothing and await their settlement payment, submit a claim form if required to establish eligibility, opt out of the settlement entirely if they prefer to pursue their own legal action, or object to the settlement terms before the court’s final approval hearing. The court must approve the settlement before it becomes final and binding on all parties involved.
